This Privacy Policy outlines „SoniTon-Training" App – ( „we“, „our“, „us“, „Kog. Kon. GmbH“, „controller“ or „the company“) practices with respect to information collected from users who access our mobile app („apps”, „software“), visit our social media profiles (such as, but not limited to, Facebook, Instagram, Twitter, LinkedIn, Xing; collectively: “social media”, “social network”), or otherwise share personal information with us (collectively: „you“, „user“, „users“, „data subject“ or „data subjects“).

Grounds for Data Collection

Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter „Personal Information“) may be necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we may be subjected.

When you use the app, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy. Where explicit consent is required by law (such as the GDPR) in order to process Personal Information, you will be prompted for consent prior to collecting, storing or processing such data.

We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions.

Data Retention

We do not retain any of your Personal Information unless it is absolutely necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. What information do we collect?

We do not purposefully collect, store or process any Personal Information without legitimate interest and only do so when it is required to be able to offer our services. Therefore, no permanent records with Personal Information are kept, since we do not need it unless you contact us or otherwise initiate communication with us directly or indirectly. This also means that we do not store information about user consent when user consent is not explicitly required or when storing of such information will require obtaining Personal Information from you solely for the purpose of storing the consent information. However, we may use third-party services that may need to obtain certain Personal Information and user data in order to be able to provide their services, which in turn may require user consent. By using our software, certain anonymous information, as well as Personal Information, such as your Device ID, Advertising ID, IP address, and other device and usage data may be made available to us.

We use any of the data and information that is made accessible to us (such as your Personal Information) very carefully. We do not rent or sell any of that data or information and only share Non-Personal Information as well as Personal Information as described in this Privacy Policy for the sole purpose of being able to provide our website and offer our services and apps.

Personal Information that you disclose with us voluntarily will only be used for the single purpose of communicating with you, and only in case you contact us. We do not initiate contact to you by ourselves. We do not offer any newsletter or other informational services to subscribe to. We do not tailor marketing based on Personal Information and do not offer personalized advertisements on our website or in our apps and games so long as you do not consent to it.

Furthermore, we use anonymous usage and device data for statistical and analytical purposes to improve our website, services and the apps and games that we offer. This is required in order to ensure that our website, apps and games function correctly and to improve the overall user experience.

We may share Personal Information with our trusted third-party providers, who may be located in different jurisdictions across the world, for any of the following purposes:

Third-party service providers that we share information with include Google, Unity Technologies, as well as different Ad Technology Providers and Facebook. More information on these providers can be found in the following sections (“Third-party services that we share information with”).

Third-party services that we share information with

Non-Personal Information as well as Personal Information may be shared with the following third-party service providers for the purposes mentioned above (c.f. “How is the information used? With whom do we share information?”) when using our apps or games.

We use several services offered by Google such as AdMob and the Google Mobile Ads SDK to display ads from various Ad Technology Providers, Google Analytics to track anonymous usage statistics and events such as crashes, as well as the services offered through the Play Store and the Google Play Games Services.

Additionally, Unity Analytics may be used to measure anonymous usage statistics and track In-App Purchases. In-App Purchases are realized through a Unity plugin in combination with the Play Store by Google for which Unity Analytics needs to be enabled.

Furthermore, we may use social networks and profiles to provide additional ways to contact us and share information, updates and news about our games, apps and services. A social network is a place for social meetings on the Internet, an online community, which usually allows users to communicate with each other and interact in a virtual space. A social network may serve as a platform for the exchange of opinions and experiences, or enable the Internet community to provide Personal Information or business-related information. On our website, we have integrated components of the enterprise Facebook. Facebook is a social network and allows its users to include the creation of private profiles, upload photos, and network through friend requests.

Use of script libraries (Google Web Fonts)

In order to present our contents correctly and graphically appealing across all browsers, we use script libraries and font libraries such as Google Web Fonts (https://www.google.com/webfonts) on this website. Google Web Fonts are transferred to your browser’s cache to avoid multiple loading. If your browser does not support Google Web Fonts or does not allow access, content will be displayed in a default font.

Third-party collection of information

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to.

This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy.

How do we safeguard your information?

We take great care in implementing and maintaining the security of the website, our services and your information. You cannot contact us through our website or apps and games directly and since we do not store any Personal Information on our own servers, we do not provide any additional safety measures other than already in place by the providers of the services we use. Our website uses SSL encryption to ensure minimum data security. In the event of us ever collecting, storing or processing any user data or Personal Information directly, we will implement the required safety measures in order to guarantee that your data will always be secured by current standards. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our website or services, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Transfer of data outside the EEA

Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection or enter into legal agreements ensuring an adequate level of data protection.

Marketing

We do not use your Personal Information for marketing purposes.

Corporate transaction

We may share information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.

Minors

We understand, acknowledge and support the importance of protecting children’s privacy, especially in an online environment. Neither the website nor our games and apps are designed for or directed at children. Under no circumstances shall we allow use of our services by minors without prior consent or authorization by a parent or legal guardian. We do not knowingly collect Personal Information from minors. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us immediately at kog.kon.gmbh@gmail.com.

Updates or amendments to this Privacy Policy

We reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the „Last modified“ section. Your continued use of the Platform, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.

Terms of Use

The SoniTon-Training App is a free service from us. We are allowed to block/ban your account at any time. Also we can not guarantee that the app is flawless. At all, we are not liable for any issues. Furthermore it’s possible, that we stop our service immediately and the app isn’t working any more. You have no rights for compensations at any time.
